  Partial or full loads: --We work with truck brokers to fill back hauls or full loads at greatly reduced prices and nationwide coverage.
       
  Terms and Conditions of Sale
  1. Contract. The invoice is a binding agreement, with all terms and conditions set forth. The written invoice shall take precedence over any other oral or written statements or comments.
  2. Price. Equipment and parts will be invoiced at the prices in effect at the time of the sale. All sales are final. Prices are subject to change without any written advance notice. All prices quoted at the time of sale are not inclusive of any sales or excise tax.
  3. Shipping. All equipment and parts are F.O.B. Empire Equipment's Plant. Buyer is responsible for any freight chargers and or any freight damage. All claims (if any) for freight damage shall be filed by the buyer.
  4. Payment. All Parts and Equipment shall be paid in full before the shipping date. Methods of payment shall be by: Check, Major Credit Card, Wire Transfer, or by previously approved lease purchase agreement.
  5. Limited Warranty and Disclaimer. E.Q. warrants that the equipment sold will be as described on the invoice, and is fit for its intended use. Any warranty as described below shall start the day following the delivery.

    Warranty will be limited to replacement of parts only. Cost of replacing the parts shall be borne by the buyer. All replaced parts shall be returned to E.Q. within 10 days for credit.
  6. Governing Law. The validity, interpretation, and performance of the contract shall be governed by the laws of the state of South Dakota.
